Who Investigates

In Kalamazoo County, Michigan, all law enforcement officials are mandated by law to investigate animal cruelty. When officials do not investigate they are guilty of a crime.

Summary: This statute provides that it is the duty of the officials involved in animal cruelty investigations to arrest and prosecute those committing the offenses where there is knowledge or reasonable notice of the acts. The failure or neglect by an officer involved to do so may result in a misdemeanor.

Statute in Full: It shall be the duty of all sheriffs, deputy sheriffs, constables, policeman and public officers, to arrest and prosecute all persons of whose violation of the provisions of the preceding sections of this chapter they may have knowledge or reasonable notice, and for each neglect of such duty, the officer so offending shall be deemed guilty of a misdemeanor. (MCL 750.52)

A good felony anti-cruelty law should:

* Apply to all animals.
* Apply to first-time offenders.
* Have large fines and lengthy prison time as penalties.
* Have no exemptions.
* Allow or require convicted abusers to get counseling at their own expense.
* Prohibit abusers from possessing animals or living where animals are present.
